What Do You Think?

  1. This is overall a GOOD thing for our crazy, convoluted legal system today. Far too often, prisoners get railroaded by court procedure and by numerous, overlapping laws. If a man steals a book, should he be prosecuted for stealing the book AND for using public transportation to execute a crime AND for carrying a weapon while engaging in a crime AND for communicating a threat when he promised to 'hurt' the book owner if the owner did not surrender the books? Should he also be charged with a hate crime if the person he stole the book from was a "specially protected" class like homosexuals or females or children or elderly or disabled persons?? If someone drove him to the bus and someone else picked him up from the bus, should he also be charged with conspiracy to commit a crime? If he texted somebody bragging and posted a video online showing him stealing the book, should he ALSO be charged with privacy/doxxing issues and for cyberbullying and for some other crime related to the posting of a violent act on the internet? If he stole aid book with a child as a witness, scarinng the child, should he ALSO be charged with reckless child endangerment or with child abuse or a misdemeanor offense of cursing in front of a child???

    NOTE: THESE ARE ALL POSSIBLE charges just for a single misdemeanor activity of stealing a book WITHOUT actually using a deadly weapon to threaten.

    Holding a weapon in hand, even something not normally intended as a weapon (ball bat, pry bar, wrench, frying pan, etc.) adds more charges from the least charge of brandishing a weapon to greater charges of assault with a deadly weapon. Mind you … simply HOLDING the weapon can result in those charges, WITHOUT swinging or pointing it directly at the victim.

    So a SINGLE TINY theft of a $10 paperback could result in 40-50 years of prison IF a judge decides to not dismiss the extra charges AND also decides the charges will be CONSECUTIVE vs CONCURRENT.

    This gets even worse for somebody who steals a single joint while holding a knife or worse, a gun ….

    Stealing a $5-10 illegal substance results in more mandatory charges while holding/carrying a firearm adds a LOT more legal trouble, despite the carrying of arms to be perfectly legal for US citizens.

  2. All crimes are crimes of violence. A crime is an act harmful to another person (or their property), not disobedience to the "laws" corrupt politicians write down on paper.

  3. How is shooting someone during a robbery, attempted or otherwise, not a crime of violence? If someone is pointing a gun at you, that's a crime of violence imho

  4. From someone who spent time in prison, unless someone is actually in prison for at least 6 years, they have not learned to want to avoid incarceration. Until that time, they only regret being caught.

  5. Looking at the "innocent" people who were executed because the Clinton administration destroyed their chance at appeal, I have to agree with the court. They are not harming other people where they are locked up – so make gd sure you have the right person, for the right crime, and not railroaded so they can close the case or the lead detective was incompetent. I think more people should serve time – but at the beginning, when they can measure where their behavior is going to take them. Catch and release does not work. And I'm not talking years, I'm talking seven days for shoplifting. Let it go from there. Catch and release does not work unless you are willing to truly work toward change. After five days, you get to choose and I believe many would.

  6. 1st why wasn’t he charged with attempted murder? 2nd, how can someone shooting people during the commission of a crime not be considered violent? Lastly, we have some REALLY stupid rulings coming from scotus.

  7. The scum in our Government are already planning on staying out of prison on appeals…
    The supreme puppets should be charged with the rest of the treasonous enemies of the Constitution infesting our Country.

  9. Roman, you did a great job on a complicated case! There needs to be some type of limit! We all know people who would bombard the system for the heck of it! Also, who's paying for the lawyers, etc? Please don't tell me that "we the taxpayers are!!!"

  10. TL;DR Our "Legal System" is a fucking joke meant to protect the wealthy and special interest groups, and imprison normal white people.

  11. This is truly disturbing. If it wasn’t for the fact that this man had shot two guards, it should have been up to the the two victims whether or not this could be designated a violent crime. If getting shot during the commission of a robbery is not an act of violence then what is considered an act of violence ???

  12. Thank you SCOTUS. It makes sense anyone who is in prison on Felony convictions would wish to appeal their circumstances.
    Being allowed to appeal and getting your appeal approved are two very different things…

  13. So this means Democrats can do unlimited appeals for ille.gals… and din.dus… and….. Hindering effects to enforce the law as needed.

  14. A lot of emotional responses, none of them really logically thinking. So here it, regardless of the crime when a law has ambiguity and doesn't fully vet itself then yes things like this happen, especially when parts of it is struck down by the supreme court. The rulings have to be followed simple as that, regardless of how anyone feels. Secondly, think beyond the person in prison, how this affects those wrongly accused or just didn't have a good enough lawyer to properly defend themselves.

    Just a few examples I'm naming.

  15. The Supreme court is right, but how on Earth is the underlying law NOT recognizing shooting guards as a crime of violence ? Judges are left picking up after a poor job by the legislators, WRONG.
