President Donald Trump wasted no time in making major moves on immigration as he stepped into the Oval Office.
On Monday, he signed an executive order that could reshape the future of birthright citizenship in the U.S. This order clarifies that children born to illegal immigrants on American soil would not automatically receive U.S. citizenship.
Trump acknowledged the potential controversy and legal battles ahead, but he stands firm, calling automatic citizenship “just ridiculous” and expressing confidence that he is on “good [legal] ground” to make this change.
The concept of birthright citizenship has been part of the U.S. Constitution since the landmark Supreme Court decision in United States v. Wong Kim Ark in 1898. Despite its longstanding history, Trump’s bold step challenges this precedent, reflecting his campaign promises to prioritize the nation’s borders.
Alongside the citizenship order, Trump declared a national emergency at the southern border, emphasizing the need to curb illegal immigration. “That’s a big one,” he commented to reporters as he signed the declaration. His commitment to securing the border was a central theme during his campaign, and he wasted no time in making it a reality.
Trump has consistently stated his support for legal immigration, noting that immigrant labor is vital for economic growth, especially with his plans for increased tariffs. “I’m fine with legal immigration. I like it. We need people,” he stated, highlighting the distinction between orderly immigration and illegal crossings.
Returning to the White House, Trump capitalized on his promise to boost border security and tackle illegal immigration.
Republicans, along with Trump, argue that mass deportations are essential after millions of immigrants crossed illegally during former President Joe Biden’s administration. In his inaugural speech, Trump criticized the government’s past failures to protect American borders and pledged immediate action against illegal entry.
“All illegal entry will be immediately halted … and we will begin the process of returning criminal illegal aliens,” Trump proclaimed, announcing plans to deploy troops to the border to counter what he described as a “disastrous invasion” of the country.
Further measures include invoking the Alien and Sedition Acts of 1798 and designating Mexican drug cartels as foreign terrorist organizations. Trump also aims to end the “catch-and-release” practice that allows illegal immigrants to pursue asylum within the U.S.
Data from early 2022 estimated there were about 11 million immigrants in the U.S. illegally or with temporary status, but some analysts believe this number could now be between 13 to 14 million. Trump’s administration is doubling down on its message to potential illegal immigrants: “Turn Back Now.”
Trump’s deputy chief of staff for policy issued a stern warning, urging those seeking unauthorized entry to reconsider. “All illegal aliens seeking entry into the United States should turn back now. Anyone entering the United States without authorization faces prosecution and expulsion,” he stated on social media.
The administration also ended the CBP One app, which had been used to schedule entry appointments at border ports for undocumented individuals. Effective January 20, 2025, these functionalities were terminated, and all existing appointments canceled, signaling a shift in border policy.
Trump’s sweeping orders are expected to face significant legal challenges from groups like the American Civil Liberties Union (ACLU), which has already expressed its intent to litigate.
The ACLU previously indicated a readiness to oppose such mandates, stating, “As we ready litigation and create firewalls for freedom across blue states, we must also sound the alarm that what’s on the horizon will change the very nature of American life for tens of millions of Americans.”
