Under a 2015 law, βout-of-network emergency providers can no longer bill the patient for amounts left unpaid by insurance. Instead, providers can seek higher reimbursement from the health plan.β The result? βA powerful incentiveβ for βemergency room doctors and orthopedic surgeonsβ to βrefuse to join Medicaid managed care provider networks.β If lawmakers want to shield Medicaid recipients from federal cuts, closing this βneedlessly expensiveβ loophole is a βrelatively painless step to take.β
