The Pentagon announced it is investigating Sen. Mark Kelly (D-AZ) for “serious allegations of misconduct” and may recall him to active duty to face a court-martial or administrative punishment, according to CNN.
The probe centers on a video in which Kelly and five other Democratic lawmakers urged U.S. troops to defy “illegal orders,” as CNN reported, and that footage is the focal point of the Pentagon’s review.
Defense officials are said to be weighing a range of penalties — including recalling Kelly to active duty for court-martial, reducing his rank, or lowering his pension if he is not court-martialed — actions the Pentagon is still “looking at,” per CNN.
Kelly is uniquely exposed because he is a retired U.S. Navy captain and therefore the only lawmaker in the video who can technically be recalled to active duty, CNN documented.

President Trump condemned the lawmakers’ actions in stark terms, labeling them “seditious behavior punishable by death,” according to CNN.
Reports also say Secretary of War Pete Hegseth (the Defense Department secretary) is reportedly involved in deliberations over whether to recall Kelly and what punishments to pursue, CNN reported.
