Comey on the Brink: Ex-FBI Boss Faces Possible Indictment for Lying to Congress

Former FBI Director James Comey may soon face indictment in federal court in Virginia, according to reports. The potential charges come amid long-standing tensions with President Trump, who fired Comey during his first term and has frequently accused him of corruption.
The development follows the resignation of interim U.S. Attorney Erik Siebert, who had opposed bringing charges against Comey. Siebert was replaced by Lindsey Halligan, a lawyer who has previously represented Trump. Soon after, Trump publicly declared Comey “guilty as hell.”
Golden State Times reports that prosecutors are weighing charges related to Comey allegedly lying to Congress during a September 2020 hearing. The allegation centers on whether Comey denied authorizing a leak to The Wall Street Journal about an investigation into Hillary Clinton’s emails. Former Deputy FBI Director Andrew McCabe has claimed that Comey knew of and approved the disclosure, while Comey has consistently denied it—leaving the two accounts in direct conflict.
Sources told us that a Justice Department memo argued against prosecution, citing insufficient evidence to establish probable cause or secure a conviction. DOJ guidelines require prosecutors to believe they can win beyond a reasonable doubt before moving forward. Still, the five-year statute of limitations for lying to Congress expires next Tuesday, placing urgency on the case.
Sen. Ted Cruz has pushed the Justice Department to resolve the contradiction, writing that either McCabe or Comey must have lied under oath—a federal crime.
Neither Comey nor federal officials have yet commented publicly on this report.
