Sen. Rand Paul (R-KY) introduced legislation to eliminate the liability shield for vaccine manufacturers, which has been in effect for 40 years.
Under the 1986 National Childhood Vaccine Injury Act, vaccine manufacturers are protected from product liability lawsuits.
Most injury claims must go through the National Vaccine Injury Compensation Program (VICP).
“For 40 years, the 1986 National Childhood Vaccine Injury Act has acted as a fortress, protecting billion-dollar corporations from being held accountable for their products. This legal shield has stifled transparency and left countless families without a path to justice,” the Vaccine Safety Research Foundation (VSRF) wrote.
“By dismantling this immunity, S. 3853 would return vaccine manufacturers to the same standard of accountability as every other industry in America. No more ‘no-fault’ systems. No more special treatment. If a product causes harm, the manufacturer must answer for it in a court of law. At VSRF, we’ve been advocating for this shift since day one. This bill is a massive step toward restoring scientific integrity and protecting the next generation. It’s time to put people over profits,” it continued.

According to Paul, the bill would make pharmaceutical companies more accountable by allowing people to sue them if they believe they have been injured by vaccines.
Vaccine safety monitoring data maintained by the Centers for Disease Control and Prevention shows that there have been millions of adverse event reports filed.
In the past, a study done in collaboration with the US Department of Health and Human Services found that the nation’s main vaccine adverse event reporting system captures fewer than 1% of adverse events.

Children’s Health Defense, the Kennedy-founded group, and other members of the Medical Freedom Act Coalition say they want every state to introduce and pass medical freedom bills.
“I think it’s the first time we’ve seen this kind of effort in the kind of freedom and health movement,” Leslie Manookian, who founded the Health Freedom Defense Fund, told The Epoch Times.
The model state is Idaho, which in 2025 enacted a law that prohibits businesses and schools from requiring customers, employees, and students receive vaccines or other medical procedures. Manookian helped write the legislation, called the Idaho Medical Freedom Act.
“Because that passed, it really showed what was possible,” Leah Wilson, executive director and co-founder of Stand for Health Freedom, and one of the leaders of the coalition, told The Epoch Times. “Our goal is to take the Medical Freedom Act to as many states as possible across the U.S.”
“Children’s Health Defense finds vaccine mandates and medical mandates reprehensible, and we are honored to be part of a coalition fighting to end forced medical procedures, to end medical mandates and vaccine mandates for all Americans,” Michael Kane, director of advocacy for Children’s Health Defense, told The Epoch Times.
