A federal judge appointed by former President Barack Obama has ordered the release of an El Salvador national who is a convicted sex offender and gang member with several illegal entries into the United States.

Earlier this month, U.S. District Judge Susan Richard Nelson ordered the release of Carlos Antonio Flores-Miguel, an MS-13 gang member from El Salvador, from U.S. Immigration and Customs Enforcement (ICE) custody, according to the Department of Homeland Security (DHS).

“This activist, Obama-appointed judge RELEASED Carlos Antonio Flores-Miguel, a criminal illegal alien from El Salvador and MS-13 gang member, from ICE Custody,” Acting Assistant Secretary Lauren Bis stated. “Releasing violent criminals is inexcusably reckless and now this criminal will be able to perpetrate more crimes against innocent Americans.”

“Petitioner’s unlawful detention has been unnecessarily prolonged by a series of missteps on the part of respondents,” wrote Nelson upon ordering his immediate release from custody.


 

The judge argued that some issues emerged from two months of litigation while Flores-Miguel was transferred back and forth between federal and criminal custody.

“The Court finds that release is the appropriate remedy here and orders the immediate release of Carlos,” Nelson concluded.

Flores-Miguel first crossed into the U.S. in September, 2016, under the Obama administration, and was deported the next month. He entered and was removed a second time in March 2017, under President Donald Trump. The criminal entered a third time in October, 2021 and was released into the country in 2022, under the administration of former President Joe Biden, the DHS said.

 

On January 20th, ICE arrested him in Minneapolis during Operation Metro Surge, in which thousands of federal immigration enforcement officers were deployed to Minnesota. He violently resisted arrest by punching and kicking officers, as well as allegedly taking hold of one agent’s gun holster, according to authorities.

Resisting an officer is one of many offenses under Flores-Miguel’s belt, also including rape and illegal re-entry into the country.



 

“President Trump is enforcing the law and arresting illegal aliens who have no right to be in our country. We are applying the law as written,” Bis said in a DHS press release. “If an immigration judge finds an illegal alien has no right to be in this country, we are going to remove them. Period.”
