Breyers Ice Cream is dishing out nearly $9 million as part of a class action settlement and millions of Americans may qualify.
The Supreme Court of New York announced that a settlement was reached between Unilever and Conopco Inc., the advertiser and parent company of Breyers.
The lawsuit stems from the company claiming its ice cream contains real vanilla flavors.
Customers who purchased the ice cream from April 21, 20-6, from August 14, 2024, may be eligible to receive cash.
The lawsuit will reward qualifying customers $1 per carton of Breyers bought during the timeframe.

The Supreme Court ofΒ New York State,Β Bronx County, announced the settlement against Conopco Inc. andΒ Unilever United States Inc. on Sept. 13. Conopco and Unilever are the advertiser and parent company of Breyers, respectively.The class action lawsuit pertains toΒ Breyersβ Natural VanillaΒ ice cream flavor, which allegedly falsely advertised itself as having real vanilla flavor.
βPlaintiffs filed this lawsuit against the Defendants alleging the Defendantsβ labeling of Breyers Natural Vanilla ice cream gave consumers the impression the ice cream contained vanilla flavor derived only from the vanilla plant and not from non-vanilla plant sources, and allege that it contained non-vanilla plant vanilla flavors,β the court explained in a release.
Consumers who purchased the Natural Vanilla flavored-ice cream between April 21, 2016, and Aug. 14, 2024, may be entitled to cash.
The court will pay consumers $1 per carton of Breyersβ Natural Vanilla ice cream flavor they purchased.

If you bought select Breyers Natural Vanilla ice cream products, you may be eligible to receive part of an $8.85 million settlement. The settlement is the result of a class-action lawsuit brought against Conopco, Inc., and Unilever United States, Inc. It alleged that the labeling on Breyers Natural Vanilla ice cream incorrectly led consumers to believe the flavoring came from only the vanilla plant and not non-vanilla plant sources.
Conopco and Unilever United States have agreed to settle the lawsuit while admitting no wrongdoing. This means that, if you purchased ice cream products covered under the settlement, you may be entitled to file a claim. Hereβs the pertinent info:

Breyers Natural Vanilla ice cream in any size
Dates purchased: April 21, 2016, through August 14, 2024
Potential settlement amount: $1 for each product that you have proof of purchase for, or $1 each for a maximum of eight products if you do not have proof of purchase

Johnson & Johnson said Tuesday itβs offering up to $8.9 billion to resolve lawsuits accusing the company of selling baby powder that caused cancer β an allegation that J&J has repeatedly denied.
Why it matters: J&J faces tens of thousands of lawsuits from people and their survivors related to the companyβs talc-based powder.
Driving the news: J&J disclosed the offer Tuesday in connection with its decision to re-file its subsidiary LTL Management in Chapter 11 bankruptcy.
The Third Circuit Court of Appeals in January dismissed the original Chapter 11 petition made by LTL, the subsidiary J&J created for the purpose of housing its talc liabilities and filing for bankruptcy.
Details: The $8.9 billion in payments to alleged victims would be paid over 25 years βto resolve all the current and future talc claims,β J&J said in a statement.The company, which originally offered $2 billion, said it βhas secured commitments from over 60,000 current claimantsβ to support the deal.
J&J noted that it is not admitting wrongdoing β but fighting the cases βwould take decades and impose significant costsβ with βmost claimants never receiving any compensation,β said J&Jβs worldwide vice president of litigation, Erik Haas.What theyβre saying: Law firms representing what they described as a majority of the victims released a statement saying their clients are supporting the proposed deal.
βThis settlement will provide expeditious, substantial and fair compensation to claimants who cannot afford to wait any longer for a resolution,β the victimsβ representatives said Tuesday in a statement.

In new research, Consumer Reports tested a total of 126 products from stores like Walmart and Trader Joeβs and found that 40 βhad high enough levels of arsenic, lead, and cadmium combined, on average, to pose a health concern for children when regularly consumed in typical serving sizes.β Beyond big-brand names like McCormick and private labels, the offenders also include spices and herbs from the beloved Wauwatosa, Wisconsin-based brand Penzeys.
Itβs important to note that there is no safe amount of lead, especially for children. Thatβs because our bodies donβt have a way to digest heavy metals, so they can easily accumulate in the body, physically interfering with other processes. (Remember when Entourageβs Jeremy Piven blamed a public outburst on mercury poisoning because heβd been subsisting on only sushi?)
βIn children, [lead] can affect brain development, increasing the risk for behavioral problems and lower IQ,β Consumer Reports explains in the report, published last month. βIn adults, it can contribute to central nervous system problems, reproductive problems, and hypertension, and can damage kidney and immune function.β
Lead in foodstuffs is usually tested through a standard protocol laid out by the U.S. Food and Drug Administration (FDA), known colloquially as βEAM 4.7.β EAM stands for Elemental Analysis Manual for Food and Related Products. βThis resource serves as a reference, for analysts at the FDA and around the world, providing not only general analytical information and procedures and detailed laboratory methods, but also helpful notes from analystsβ experiences using these methods,β the FDA explains online. In this testing, an acid chemically βdigestsβ foods before theyβre fed through a mass spectrometer machine that identifies the chemical signatures of different elements.
Which Herbs and Spices Contained High Levels of Lead?
Consumer Reports tested a total of 126 products across 38 brands, using two or three samples for each product. They ranked products from least to most concerning with the following system: no concern, some concern, moderate concern, and high concern. Here are the products that ranked as moderate or high concern:
- La Flor Ground Oregano
- La Flor Ground Turmeric
- Happy Belly (Amazon) Ground Thyme
- Spice Islands Sweet Basil
- Toneβs Ground Thyme
And from Consumer Reports:
Roughly one-third of the tested products, 40 in total, had high enough levels of arsenic, lead, and cadmium combined, on average, to pose a health concern for children when regularly consumed in typical serving sizes. Most raised concern for adults, too.
For two herbs, thyme and oregano, all the products we tested had levels that CR experts say are concerning.
In 31 products, levels of lead were so high that they exceeded the maximum amount anyone should have in a day, according to CRβs experts.
When people think about heavy metals in their diet itβs probably the lead in their drinking water. But our tests show that dried herbs and spices can be a surprising, and worrisome, source.
Also troubling: There was no single predictor of which products contained higher levels of heavy metalsβfor example, brand name didnβt matter, and neither did βorganicβ or βpacked in USAβ claims.
