The House of Representatives has voted to hold Attorney General Merrick Garland in contempt of Congress. This comes after Garland had declined to provide subpoenaed audio recordings of President Joe Biden’s interview with Special Counsel Robert Hur.

On Wednesday, Garland was held in contempt in a 216-207 vote. This was a major win for House Republicans, as they could only afford to lose two votes in order to pass the measure.

Only one Republican, Representative David Joyce (R-Ohio.), voted no.

“As a former prosecutor, I cannot in good conscience support a resolution that would further politicize our judicial system to score political points. The American people expect Congress to work for them, solve policy problems, and prioritize good governance,” Joyce said in a statement after the vote.

Shortly after the vote, the DOJ released a statement from Garland.

“It is deeply disappointing that this House of Representatives has turned a serious congressional authority into a partisan weapon. Today’s vote disregards the constitutional separation of powers, the Justice Department’s need to protect its investigations, and the substantial amount of information we have provided to the Committees,” Garland said.

“I will always stand up for this Department, its employees, and its vital mission to defend our democracy,” he continued.

During Hur’s interview with Biden, he concluded in a 435-page report that the Department of Justice would not prosecute Biden. Hur reasoned that a jury might perceive the president as “a sympathetic, well-meaning, elderly man with a poor memory.” Based on this assessment, he chose not to pursue criminal charges against Biden and stated that the evidence did not prove beyond a reasonable doubt that Biden had violated the law.

Garland is now the third attorney general in history to be held in contempt of Congress. However, it is unlikely that he will face criminal charges, as it is his department, the DOJ, who would be prosecuting him.

Additionally. The White House exerted executive privilege over the audio recording, suspiciously shielding it from Congress.
