There has been a huge debate about H1-B Visas and whether we need them or not, and whether they hurt American workers or not.

The short answer is, we probably need some especially in highly specialized Big Tech roles to keep our lead as the world leader in tech, but it’s also probably true that the program has been vastly abused and has greatly hurt American workers.

Of course President Trump found the perfect solution to address both issues….

You just change the fee from $1,000 to $100,000 and you solve both problems!

And shockingly, a Federal Judge just sided with President Trump holding the new fee is perfectly legal and Constitutional!

Usually President Trump has to go all the way up to the Supreme Court to finally get a win, so it’s nice to see one at a lower level like this:

The Hill notes that while it is a great win for Trump, the other side could still appeal:

U.S. District Judge Beryl Howell rejected a challenge filed by the U.S. Chamber of Commerce and the Association of American Universities, which alleged the move was unlawful. Earlier this month, 18 Democratic states also filed a lawsuit against the Trump administration over the H-1B visa application fee.

However, the groups have the right to appeal.

The ruling comes after months of immigration reform under President Trump and is likely to impact technology companies, known for using H-1B visas to hire foreign skilled workers.

The change coincides with other adjustments to the visa program, which include the replacement of the random lottery for H-1B visa applicants.
